Terms and Conditions

This AGREEMENT is made between you the user and/or subscriber and/or member hereinafter referred to as (“You”), and Shubh Labh Ventures LLC, doing business as Cash Cow Cafe, the owner of www.cashcowcafe.com hereinafter referred to as (“Cash Cow Cafe”) or (“the Service”) or (“Shubh Labh Ventures LLC”).

 

By using the Service, you agree to be bound by these terms and conditions. If you do not agree to these terms and conditions, do not use the Service.

 

You acknowledge that CASH COW CAFE and all individuals or affiliates associated with CASH COW CAFE are not licensed nor serving as an investment advisor or broker dealer with respect to you. CASH COW CAFE does not recommend or suggest which securities You should buy or sell for yourself.  You agree that CASH COW CAFE shall have no liability whatsoever for investment or other decisions based upon any content provided in the service or any contrarian view of any content.  All investment decisions are solely made by You.

None of the information contained from time to time while You are a subscriber constitutes a recommendation of a particular security, portfolio, transaction or investment strategy is suitable for any specific person.  You specifically agree by subscribing to this service that under no circumstances shall CASH COW CAFE be liable for any loss or damage of any kind whatsoever by your reliance upon information obtained from CASH COW CAFE website.  You acknowledge the fact that stock, crypto and options trading involves risk and is not suitable for all investors, including You. You acknowledge that any risk management information shared by CASH COW CAFE is solely for education purposes and may not work for You or individuals.

Any donation, compensation or subscription payments or payments in any other form or reason from You to CASH COW CAFE are non-refundable unless specified as such by the receiver of payments.

 

Changes to Agreement and Terms and Conditions

We reserve the right at any time to:

  • Change the terms and conditions of this Agreement; or

  • Change the Service, including eliminating or discontinuing any content on or feature of any of the Service; or

  • Change any fees or charges for use of the Service; or

  • Sell, transfer or otherwise share some or all of the Shubh Labh Ventures LLC assets, including your personally identifiable information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

Your continued use of the Service indicates your acceptance of all revisions, and you should, therefore, periodically visit this page to review these policies for changes.

Conditions of Use

While using the Service you must not do any of the following:

  • Attempt to hack/crack or in any way restrict access to the site for others or obtain administrative access for yourself

  • Harass other members

  • Flood or spam the chat room with advertisements or solicitations purposes

  • Transmit any materials that contain any viruses or other harmful or disruptive software

  • Record and distribute any members only content

  • Create a hostile environment for other members through actions in or out of our chat room.

  • Attempt to steal our content from other members

  • Attempt to solicit personal information from our members

  • Attempt to steal content from Cash Cow Cafe

  • Solicitation of any non Cash Cow Cafe products

  • Use multiple logins or email accounts to access our site

Violation of any of the Conditions of Use may result in termination of membership without refund and/or further legal action.

Termination

Cash Cow Cafe may terminate your account and discontinue your access to the Service for any reason, or no reason, at any time in its sole discretion, with or without notice.

DISCLAIMERS AND MANDATORY ARBITRATION OF DISPUTES

 

CASH COW CAFE and SHUBH LABH VENTURES LLC MAKES NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THE INFORMATION PROVIDED.  ALL INFORMATION PROVIDED IS ON AN “AS IS”,  “AS AVAILABLE”  BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER TO THE FULLEST EXTENT PERMITTED BY LAW. CASH COW CAFE and SHUBH LABH VENTURES LLC DISCLAIMS ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, ARISING BY STATUTE, CUSTOM, COURSE OF DEALING, COURSE OF PERFORMANCE OR IN ANY OTHER WAY. CASH COW CAFE and SHUBH LABH VENTURES LLC DISCLAIM ALL REPRESENTATIONS AND WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE  OF THE INFORMATION PROVIDED OR THAT THE CONTENT OF THE INFORMATION PROVIDED IS ACCURATE, COMPLETE OR CURRENT.  CASH COW CAFE and SHUBH LABH VENTURES LLC DOES NOT REPRESENT OR WARRANT THAT THE INFORMATION  AND ANY TRANSMISSIONS SENT FROM CASH COW CAFE and SHUBH LABH VENTURES LLC IS FREE OF ANY HARMFUL COMPONENTS, INCLUDING BUT NOT LIMITED TO COMPUTER SOFTWARE VIRUSES.  YOU HEREBY AGREE TO THE HEREINABOVE MENTIONED DISCLAIMERS.

 

TO THE FULLEST EXTENT PERMITTED BY LAW, CASH COW CAFE AND SHUBH LABH VENTURES LLC ON ITS OWN BEHALF AND ON BEHALF OF ITS OWNERS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS AND AFFILIATES EXCLUDE AND DISCLAIM LIABILITY FOR ANY LOSSES AND EXPENSES OF ANY NATURE WHATSOEVER, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, GENERAL, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF USE, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY, CLAIMS OF THIRD PARTIES FOR INDEMNICATION OR SUBROGATION OR OTHERWISE WHETHER LIABILITY IS BASED UPON CONTRACT, TORT OR STRICT LIABILIY OR ANY OTHER BASIS.  YOU AGREE TO THESE DISCLAIMERS BY USE OF THE WEBSITE, DISCORD SERVER or OTHER SUCH SUBSCRIPTION.

 

APPLICABLE LAW IN SOME STATES MAY NOT ALLOW THE LIMITATION OF CERTAIN WARRANTIES, SO ALL OR PART OF THIS DISCLAIMER OF WARRANTIES MAY NOT APPLY TO YOU.

 

MANDATORY ARBITRATION AND WAIVER OF JURY TRIAL.

 

YOU AGREE THAT ANY AND ALL DISPUTES BETWEEN YOU AND CASH COW CAFE and SHUBH LABH VENTURES LLC SHALL BE SUBJECT TO BINDING ARBITRATION PURSUANT TO THE FEDERAL ARBITRATION ACT OR COMPARABLE STATE ARBITRATION IF THE FEDERAL ACT IS FOR ANY REASON DETERMINED NOT TO BE AVAILABLE.  IF NO STATE HAS SUCH ARBITRATION AVAILABLE THEN THE PARTIES HEREBY AGREE TO USE THE AMERICAN ARBITRATION ASSOCIATION SERVICES.  THE VENUE FOR ANY SUCH ARBITRATION SHALL BE IN THE STATE OF Massachusetts AND THE CITY OF Westford.

 

YOU AGREE TO WAIVE YOUR RIGHT TO A COURT OR JURY TRIAL AND TO PARTICIPATE IN ANY CLASS ACTION.
